You will be directed to the AQUMON platform which is independently operated by Magnum Research Limited ("Magnum") to provide you with the MPF robo-advisory services (the "Services") as a third party service provider (as referred to in Note 2 (a) to 2 (e) and the relevant terms and conditions on the AQUMON platform).
The Services provided by Magnum on the AQUMON platform utilize algorithms and other methodologies and may involve potential risks and limitations (as referred to in Note 4 and the relevant terms and conditions on the AQUMON platform). The AQUMON platform and the Services are independently operated and provided by Magnum and are not related to Sun Life Hong Kong Limited or its affiliates (“Sun Life”).
In order to receive the Services, you agree and voluntarily instruct Sun Life to transfer your personal information/ account information to Magnum for the purpose of provision of the Services (as referred to in Note 3(a) and 3(b)).
If you do not wish to receive the Services provided by Magnum on the AQUMON platform, please do not select “Agree and Continue” at the end of this Important Note.
This Important Note may be amended or updated from time to time without prior notice to you.
1. Professional Qualification for Magnum
AQUMON platform is a digital wealth management platform owned by Magnum. Magnum is granted Type 1, Type 4, and Type 9 licenses by the Securities and Futures Commission of Hong Kong (the “SFC”) (CE NO. BJU619) to carry out regulated activity in Hong Kong. Magnum is also a registered MPF intermediary with the Mandatory Provident Fund Schemes Authority (the “MPFA”) (MPF Registration No. IC001161).
2. Services offered by Magnum on the AQUMON platform
(a) assessing your risk profile through a risk assessment questionnaire, whereby your responses to each question will be mapped to a corresponding risk score to determine your risk category;
(b) presenting reference investment portfolio(s) which matches with your risk category (or lower risk) after you complete the risk assessment questionnaire, which will be based on the User Data (as defined hereinbelow), historical data and representative benchmark data, and will be generated according to different risk levels through Magnum's algorithms or other mechanisms and methodologies. If you save the reference investment portfolio(s) on the AQUMON platform, it will be updated periodically based on Magnum’s algorithms or mechanism stated above. You could only view the periodic update(s) if you re-access the AQUMON platform. On the AQUMON platform, you may either choose to follow the updated reference portfolio by selecting to re-balance your saved reference portfolio to continue monitoring the updated reference portfolio performance from that date (i.e. a rebalanced portfolio) or you may keep your previously saved reference portfolio on the AQUMON platform. On the AQUMON platform you may also make your own portfolio (i.e. a DIY portfolio) for your reference only. For the avoidance of doubt, any reference portfolio, rebalanced portfolio or DIY portfolio on the AQUMON is presented for general reference purposes only and shall not be construed as a distribution, an offer to sell, a solicitation of an offer or a recommendation of any particular or portfolio of MPF constituent fund(s);
(c) presenting historical annualized return of your existing investment portfolio(s) under the Sun Life Rainbow MPF Scheme (the "Scheme") for reference only;
(d) assessing the required annualized return from investment and savings by your desirable retirement lifestyle against your Scheme MPF and non-MPF investment and saving inputted through the retirement calculator for reference only;
(e) all Services related enquiries will be replied by Magnum. Sun Life Customer Service Department will assist with user communication only; and
(f) as a valued client of Sun Life, the cost incurred by you when using the Services provided by Magnum via the AQUMON platform will be paid by Sun Life although the Services and AQUMON platform are independently provided and operated by Magnum.
3. Policy for Storage and Transfer of User Data and Assessment Information
For the purpose of the provision of the Services, you will be directed to the AQUMON platform independently operated by Magnum and you will be subject to the Magnum’s terms and conditions binding on you as a user of the Services on the AQUMON platform. If you do not agree to terms and conditions from Magnum on AQUMON platform, you will not receive the Services and your personal and account information (see (a) below) transferred from Sun Life at your instruction to the AQUMON platform will be removed from the AQUMON platform when you leave the AQUMON platform.
By selecting “Agree and Continue” button below, you voluntarily consent to provide instructions to Sun Life for and/or give effect to the following:
(a) The transfer from Sun Life of your personal information/ account information (i.e. the gender, surname, age, the amount of your monthly contributions, account balances, the funds composition together with their respective weightings held in your account) (the "User Data") to Magnum for the purpose of the provision of the Services. The User Data will not be stored by Magnum and will be removed from the AQUMON platform whenever you leave the AQUMON platform;
(b) If your User Data held in Sun Life system is subsequently updated, the updated User Data will not be transferred to Magnum or the AQUMON platform automatically. Your updated User Data will only be provided to Magnum if you elect to re-access the Services provided by Magnum by making specific request via the Sun Life platform (i.e. by re-selecting “Agree and Continue” below in the next occasion if you wish to re-access the AQUMON platform), and that the transfer of such updated User Data will be subject to this Important Note as may be amended and updated by Sun Life from time to time;
(c) Information of the provision of the Services and your saving of the reference portfolio on the AQUMON platform (without disclosing to Sun Life any personal information or responses you provided directly on the AQUMON platform or any outcome of any assessment carried out by Magnum) will be regularly transferred from Magnum to Sun Life for the purposes of measuring the usage of the Services and sending you alert messages of periodic updates on the reference portfolio through Sun Life's platform. Magnum will not transfer any assessment information on the AQUMON to Sun Life unless it is required by or in accordance with applicable laws or regulations or regulator(s) or otherwise on a strictly need-to-know basis;
(d) Magnum shall only use the User Data for the purpose of the provision of the Services and shall not use the User Data or other information related to you for any other purposes; and
(e) Sun Life will not collect any personal information or other information you provided to Magnum on the AQUMON platform unless it is required by or in accordance with applicable laws or regulations or regulator(s) or otherwise on a strictly need-to-know basis. Any transfer or collection of your personal information from Magnum by Sun Life (if applicable) will be subject to the Personal Information Collection Statement or established protocol(s) of Sun Life.
4. Potential Risk / Limitation for the Services
The Services on the AQUMON platform intend to assist users by providing assessment in relation to retirement planning strictly for reference and information only. The statutory retirement age is 65 so the Services will not be available to you and will be suspended on your birthday at age 65.
The reference portfolio(s), rebalanced portfolio(s) and DIY portfolio(s) (as applicable)will be generated by Magnum’s algorithms or other mechanisms and methodologies based on User Data, historical data and representative benchmark data, and therefore, such portfolios are for general reference only and are not intended to be specific investment advice and the performance thereof may deviate from the expected returns so calculated. For the avoidance of doubt, the Services do not otherwise contemplate any discretionary or non-discretionary portfolio management services.
All information and materials available on the AQUMON platform (including the reference portfolios, the rebalanced portfolio(s), the DIY portfolio(s) and any information contained therein) do not constitute any advice, recommendation, solicitation or invitation for investments by Sun Life or Magnum to you and are not intended as substitutes for professional advice. You should make your own risk assessment and obtain information and review document(s) relating to any constituent funds making up the reference portfolios (including the information related to the constituent funds’ features, risks and returns), including, but not limited to, (i) the Scheme’s quarterly update; (ii) the Scheme’s brochure, and (iii) key Scheme’s information document. You should also consult your own independent legal, tax or financial advisor to seek professional advice, where necessary. Sun Life shall not be responsible for any direct, indirect or consequential loss or damage arising from or in connection with any use or reliance of the portfolios or any information contained therein.
5. Limitation of Liability
Your use of the Services and the AQUMON platform is at your own discretion and risk.
You acknowledge and understand that (i) Sun Life is NOT the operator of the AQUMON platform and does NOT provide the Services; (ii) the AQUMON platform and the Services are independently operated and provided by Magnum which is licensed under SFC and MPFA (as referred to Note 1 above); (iii) the Services and any recommended portfolio or information presented or provided on the AQUMON platform are intended for “reference only” and cannot be regarded as or substituted for any professional or investment advice; (iv) the use of the Services and AQUMON platform and its features come with certain risks (e.g. risks inherent in using algorithms and non-human interaction) (please refer to the terms and conditions on the AQUMON platform); (v) Sun Life cannot be held liable for any direct, indirect or consequential loss or damage incurred by you due to the use of the Services or the AQUMON platform or reliance on the reference portfolio(s), the rebalanced portfolio(s), the DIY portfolio(s) (as applicable) presented to you on AQUMON Platform. You are advised to carefully consider the risks associated with using the Services and AQUMON platform and its features; (vi) Sun Life shall not have any liability for any actual, suspected or threatened misuse, unauthorized distribution, loss, theft, data security breach, unauthorized or accidental access to, manipulation, erasure, exposure or leakage of any information and/or materials (including without limitation any of your personal and account information transferred from Sun Life to AQUMON platform at your instruction, any information or responses provided by you and any portfolios and assessment results or information presented on the AQUMON platform) from the AQUMON platform by you and/or any recipients of such information and/or materials or any other third party (as the case may be) or as a result of any incident.
Sun Life makes no representation or warranty (any express or implied warranties of any kind, including warranties of merchantability, fitness for a particular purpose, non-infringement of intellectual property rights, or the absence of computer viruses) to Magnum or the AQUMON platform or any of the Services or information or recommendation provided by Magnum on the AQUMON platform including their suitability, adequacy, accuracy, availability, completeness, reliability, quality or security and shall not be held liable for any losses, damage, costs or expenses whatsoever caused, arising from or related to the use of such Services or information or recommendation, and for any errors or omissions in any of the Services or information or recommendation.
Under no circumstances shall Sun Life be liable to you or any other person for any incidental, consequential, direct, indirect, special or exemplary damages of any kind or nature whatsoever or loss of opportunity arising from or connection with the provision of the Services or the use of AQUMON platform or any representation, any breach of implied term or any duty at common law or under any statute or express term of these terms and conditions, and whether such liability is asserted on the basis of contract, tort or otherwise, whether or not foreseeable, even if Sun Life has been advised or was aware of the possibility of such indirect losses or damages.
